Pop star Paolo Nutini, 30, is CLEARED of drink driving after using the 'hip flask defence' and claiming he had drunk at home before being breath-tested. But he claimed he had consumed whisky at home before being breathalysed.

The New Shoes singer, 30, was accused of driving while more than twice the legal limit in his hometown of Paisley, Renfrewshire. A witness said he saw Nutini and a friend ordering rounds of drinks in DeBeers bar in the Scottish town. But he denied the offence and was cleared at Paisley Sheriff Court after using what the court heard was called 'the hip flask defence' - drinking after he had stopped driving. His defence was 'post-incident drinking' and he claimed he consumed a large glass of whisky, part of a smaller glass of whisky and some wine at his home before police arrived to breathalyse him. The singer, dressed in a dark suit, said 'happy days' following his acquittal - before donning a pair of sunglasses and strutting down the steps of the court with a beaming smile plastered across his face.
His trial heard he drank three vodka, soda water and limes in the pub and watched a UEFA Champions League match with friends before driving home. Once he arrived home with his guests he said he drank two Bowmore single malt whiskies and had 'a mouthful of wine' before police arrived at his door. He said he had been drinking with his friend Andrew in the bar and they then headed back to the house with three girls they had met.
Nutini said he was fearful his Mini Cooper S would get damaged if it was left in Paisley overnight and said he realised he had made a huge mistake when arrested. He explained: 'I made a judgement and I decided I felt I was okay to drive. My car is very distinctive and it's known to be mine - that's why I decided to take it home. 'I felt like at that point I'd made a wrong decision and I was stupid to make it. I now won't be making my own estimations on whether or not I'm okay to drive. 'If I'm drinking in a bar in future I won't be operating a vehicle. I think what I've taken from this experience is that I was stupid and I was wrong, as soon as I was sitting in that police car I knew that was the case.'
Nutini, 30, (pictured) was on trial accused of driving on various streets in Paisley while more than twice the legal limit Karen Kerr, a forensic toxicologist with the Scottish Police Authority, gave evidence in the trial, saying she did a number of calculations on the alcohol level in Nutini's system. The 42-year-old said: 'This is the hip flask defence where someone has stated they've drank something after the incident them driving. 'It's when someone has said, 'if I hadn't drank this after the incident, this is what my reading would've been'.' But she conceded he may have been fit to drive at the time he was driving, saying: 'It is possible he would've been under the limit 22mcg at the time of driving. 'He could be as high as 36mcg or as low as 14mcg.' Pc Laura Murray told the first day of the trial she was called to Canal Street towards midnight to a report of a car being driven by someone who had allegedly been drinking. The star's case was heard at Paisley Sheriff's Court in Scotland (pictured) - close to where the alleged incident took place The car was no longer there when they arrived but they went to an address where they found a grey Mini and Nutini, who they had been told was the driver of the vehicle.

Pc Murray said she told Nutini he would need to do a breath test. Asked when his last drink was, the witness replied: 'He said it was ten minutes before police arrived.' The officer told the court Nutini tested positive for alcohol and was then arrested and taken to Govan police office for a further test. Asked whether he mentioned drinking when he got home, she said: 'He said he had had a mouthful of wine at home and this later changed to saying he had a mouthful of whisky.'
Nutini was accused of breaching the Road Traffic Act by driving with 48 microgrammes of alcohol in 100 millilitres of breath, exceeding the 22 microgrammes limit. Sheriff Colin Pettigrew acquitted the musician of the single charge after evidence was led from several witnesses about events on the night in question.
